Definitions

1. Main Tenant: A natural person renting or wishing to rent a vacation home from the Look at Estate offer.
2. Co-tenant: Someone who resides in the vacation home with the main tenant.
3. Administrator: The person who performs vacation home management duties on behalf of the owner of a vacation home.
4. Consumer: A natural person renting a vacation home and not acting in the exercise of his profession or business.
5. Third Parties: Any other legal or natural person who is not part of Look At Estate or the tenant.
6. Owner: The legal owner of a vacation home (or his/her representative) who has offered the vacation home for rental to Look At Estate.
7. Cancellation: the revocation or rescission of the booking.
8. Booking: A reservation of a vacation home accepted by Look At Estate.
9. Dissolution: The legal termination of the lease for failure to perform obligations under the lease.
10. Vacation House: A house offered by Look At Estate as vacation accommodation.
11. Stay: The actual use of a vacation accommodation.

Applicability
These general terms and conditions apply to all offers, contracts, deliveries and services of Look at Estate. We therefore request that you read these terms and conditions carefully. This states our rights and obligations as well as yours. Deviating clauses, agreements or arrangements only apply if Look At Estate has confirmed them in writing. Verbal agreements or promises by Look At Estate employees are valid only if confirmed in writing by authorized Look At Estate employees. These terms and conditions apply only to the relationship between Look At Estate and consumers, not to business relationships.


Booking your vacation
. You can make a reservation by phone or internet. Each booking order is confirmed by Look At Estate by email with an invoice/booking confirmation. If you have not received this confirmation within 3 days of booking, please contact Look At Estate immediately. The booking confirmation from Look At Estate contains all relevant details for your stay in the vacation home booked. It is the responsibility of the renter to check the accuracy and completeness of the information booked and report any imperfections or errors to Look At Estate within 7 days of receiving the booking confirmation. If such notification is not made within the stipulated period, the renter has no right to claim inadequacies or errors in the booking confirmation. Look At Estate reserves the right to refuse or withdraw a reservation request or booking without giving reasons.

De lokale wetgeving is altijd van toepassing naast deze voorwaarden. Unless otherwise agreed in the rental agreement, the tenant must leave the vacation home no later than the time specified in the rental agreement. Look At Estate is not responsible for the consequences of leaving later than the specified time. For departure after the specified time, the tenant must pay an additional rental fee per day. The tenant must behave as a good tenant and treat the vacation home with care. The tenant is responsible for damage caused by the tenant or co-tenants to the vacation home or its inventory. The renter is required to report any damage immediately to the manager of the vacation home and pay any costs for repair or replacement. The renter must abide by the house rules listed in the vacation home and follow any instructions given by the manager. The tenant may not sublet or give the vacation home to third parties.

Payment
The rent, additional charges and deposit must be paid at the time and in the manner specified in the booking confirmation. If the renter fails to make payment on time, Look At Estate has the right to cancel the booking and charge the cancellation fee as stated in these terms and conditions. The deposit will be refunded to the renter within a reasonable period of time after the end of the stay, less any charges for damage to the vacation home or inventory.

Cancellation by the renter
Cancellation of a booking must be made in writing (by e-mail) and is valid only after Look At Estate has confirmed the cancellation. In case of cancellation by the tenant, cancellation fees are due:

Unless different/different conditions are stated for the published accommodation on the Look at estate website under the heading Booking conditions or unless otherwise agreed in writing, the client is liable to pay the following immediately payable amounts upon cancellation of the contract:
a. If cancelled up to the 42nd day before departure: the entire deposit; i.e. 30% of the basic travel price
b. For cancellation from the 42nd day (inclusive) to the 29th day before departure: 60% of the basic travel sum
c. For cancellation from the 28th day (inclusive) before departure or later: the entire travel sum as well as the amounts already invoiced

The cancellation fee is calculated on the total rental price, including any additional services and charges. Look At Estate advises renters to purchase cancellation insurance.

Cancellation by Look At Estate
Look At Estate has the right to cancel a booking in the following cases:
– In cases of force majeure, such as war, natural disasters, strikes, fire, and other unforeseeable circumstances beyond the control of Look At Estate.
– If the vacation home is unavailable due to unforeseen circumstances, such as damage from fire or other calamities.
– If the tenant fails to fulfill the obligations under the lease.
In case of cancellation by Look At Estate, the renter will be refunded the full rental price and any other amounts already paid within 14 days. The tenant is not entitled to compensation in this case.

Liability
Look At Estate is not liable for damage, injury or loss of the tenant’s property while staying in the vacation home. Look At Estate is not liable for disruptions in and around the vacation home, such as disruptions in the water or power supply, or nuisance caused by construction or maintenance work in the vicinity of the vacation home. Look At Estate is not liable for consequential, indirect or intangible damages.

Complaints
Any complaints about the vacation home or the services provided by Look At Estate should be reported immediately on site to the manager of the vacation home so that he or she can attempt to resolve the complaint. If the complaint is not satisfactorily resolved, the tenant must submit the complaint in writing to Look At Estate within 14 days of the end of the stay. Look At Estate will deal with the complaint as soon as possible and strive to find an appropriate solution.

Applicable law and disputes
All agreements and disputes between Look At Estate and the tenant are governed by Dutch law. Disputes between Look At Estate and the tenant will in the first instance be submitted to the competent court in the Netherlands.

Changes
Look At Estate reserves the right to change these terms and conditions at any time. The amended terms and conditions apply to new bookings from the time of publication on the Look At Estate website. Tenants are advised to regularly check the Look At Estate website for the most current version of the terms and conditions.

Final provision
If any provision of these terms and conditions is declared invalid or unenforceable by a court of competent jurisdiction, this shall not affect the validity or enforceability of the remaining provisions. The unenforceable provision shall be replaced by a valid and enforceable provision that has as much as possible the same purpose and scope as the unenforceable provision.

These general terms and conditions are drawn up in the Dutch language. In case of any dispute regarding the interpretation of these terms and conditions, the Dutch text shall prevail.
